The AOBO met in Executive Session on Oct. 4th at 4:00 pst.
This is a summary of the results of that meeting:
A majority of the Board voted to continue to pursue the right to appeal the Phase II lease redetermination panel results and authorized counsel to prepare a Motion to Vacate the panel's decision. The Board authorized counsel to continue to negotiate with the Trust's attorneys on the various issues that are still up in the air. The estimated cost for these legal fees is approx. $50-$60K, including the Motion for Clarification.
A majority of the Board also voted to seek a legal opinion from a Harvard law professor on the likelihood of success in federal court in an action for violation of our civil rights. The estimate for this opinion is $14,000.
No action was taken with respect to the pool and/or tennis courts.
