Phase II Lease Redetermination update

In order to keep everyone updated on the status of the Phase II lease redetermination, I wanted to give you some information about what is going on.  No, there is no decision to report yet.  The hearings were held in Honolulu at the end of May.

The closing briefs were submitted by both sides on July 26th. The decision from the panel is due by Sept. 9th.

So the good news is that we should know something within the next couple of weeks.  The bad news is that there's no way to know what the result will be.

We will keep you posted on the results as soon as we hear.

Parking resolution


COUNTY COUNCIL
COUNTY OF KAUA`I
Resolution
RESOLUTION ESTABLISHING NO PARKING AT ANY TIME
AND TOW AWAY ZONES ALONG PORTIONS OF
PO‘IPŪ ROAD, KŌLOA DISTRICT, COUNTY OF KAUA‘I
WHEREAS, Chapter 16, Article 2 of the Kaua‘i County Code 1987, as
amended, authorizes the County Council to determine and designate official traffic
control devices; and
WHEREAS, Po‘ipū Road is located in the Kōloa District, County of Kaua‘i,
State of Hawai‘i; and
WHEREAS, the County Engineer, based on an engineering and traffic
investigation, has recommended that a no parking at any time and tow away
restriction be established along portions of Po‘ipū Road; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF KAUA‘I,
STATE OF HAWAI‘I, THAT:
SECTION 1. The County Engineer or his representative shall post
appropriate signs indicating “No Parking at Any Time – From Here to Corner”
and “Tow Away” zones on the northerly shoulder of Po‘ipū Road from a point one
hundred thirty (130) feet east and eighty-five (85) feet west from its centerline
intersection with Kiahuna Plantation Drive, as shown on Exhibit “A” which is
attached hereto and incorporated herein by reference.
SECTION 2. The County Engineer or his representative shall post
appropriate signs indicating “No Parking at Any Time – From Here to Corner”
and “Tow Away” zones on the southerly shoulder of Po‘ipū Road from a point
eighty (80) feet east and one hundred twenty-five (125) feet west from its centerline
intersection with the driveway entrance access for Kiahuna Plantation Resort, as
shown on Exhibit “B” which is attached hereto and incorporated herein by
reference.
SECTION 3. The County Engineer or his representative shall post
appropriate signs indicating “No Parking at Any Time – From Here to Corner”
and “Tow Away” zones on the southerly shoulder of Po‘ipū Road from a point
eighty (80) feet east and one hundred twenty-five (125) feet west from its centerline
intersection with the driveway entrance access for the Marriott’s Waiohai Beach
Club and Koa Kea Hotel, as shown on Exhibit “C” which is attached hereto and
incorporated herein by reference.
SECTION 4. The County Engineer or his representative shall post
appropriate signs indicating “No Parking at Any Time – From Here to Corner”
and “Tow Away” zones on the southerly shoulder of Po‘ipū Road from a point
seventy-five (75) feet east and one hundred ten (110) feet west from its centerline
intersection with Keleka Street, as shown on Exhibit “D” which is attached hereto
and incorporated herein by reference.
SECTION 5. Any person convicted of violating said no parking zone
restrictions shall be subject to the penalties prescribed in Section 16-21.6 of the
Kaua‘i County Code 1987, as amended. In addition to the “No Parking” penalties
imposed on the motorists, all vehicles found in violation of the “No Parking” sections
above shall be towed away and stored subject to the penalties prescribed in
Section 16-9.12, Kaua‘i County Code 1987, as amended.
SECTION 6. This Resolution shall take effect upon its approval and
the posting of the appropriate signs and/or markings.

No Parking areas on Poipu Road

Thanks to Chris Gampon for working with the County to figure out a way to get rid of a lot of those cars on Poipu Road just alongside Kiahuna Plantation. The restrictions extend 85 feet from the west entrance and 125 feet from the east entrance. So the areas immediately adjacent to the entrances will be (theoretically) free of cars being parked there!

There was a resolution that was passed making it a no parking/towaway zone!!

I'm going to try to post the original resolution so everyone can read it.
