Minutes of Oct. 4th phone meeting

 SPECIAL TELECONFERENCE OF THE BOARD OF DIRECTORS 
OF THE ASSOCIATION OF BEACHHOUSE OWNERS OF KIAHUNA PLANTATION 
October 4, 2013 AT 4:00 PM PDT

CALL TO ORDER: The special meeting was called to order at 4:10 PM by President Miller. 
President Miller announced that the Board would adjourn to Executive Session to discuss actions to be taken with respect to the Phase II minimum rent redetermination and the swim and tennis clube 
Motion: Carey moved, James seconded a motion to adjourn to Executive Session to discuss legal matters. 
The Open Session was reconvened at 6:48 PM. The owners who called in were called back and Miller spoke to them at 6:48pm. No other Board members were present and Thesken was on the line. 
Phase II Landlease Redetermination 
Miller reported the board determined that they should continue to assert the right to appeal the panel decision; authorized Counsel to prepare a motion to vacate and authorized Counsel negotiate with the Trust attorneys. 
In addition, he said the Board agreed to seek a legal opinion from a renowned law professor on the likelihood of successfully pursuing federal action in the case of the Phase II redetermination. 
Kiahuna Swim & Tennis Club 
As it relates to swim and tennis club, no action was taken.
